1. Summary in plain words
Please read these terms carefully. They are a legal agreement between you and EVDost. By creating an account or using EVDost, you agree to them. If you don't agree, don't use EVDost.
- EVDost is an online platform that helps drivers find chargers shared by hosts. We don't own, operate, install, inspect or maintain any charger.
- Each charging session is an arrangement between the driver and the host only. EVDost is not a party to it.
- Hosts are fully responsible for their chargers, premises, electricity and legal compliance. Drivers are fully responsible for their vehicles and their own conduct.
- You use EVDost and take part in charging sessions at your own risk. EVDost is not responsible for injury, damage, loss or disputes arising from a session.
- For now, drivers pay hosts directly. EVDost does not hold, handle or guarantee any payment between users.
- If a claim is brought against EVDost because of something you did, you agree to cover EVDost's costs.
- Disputes with EVDost are settled by arbitration in Pakistan, under Pakistani law.
This summary is for convenience. The full terms below are what apply.
2. About these terms
These Terms of Service (the "Terms") form a binding agreement between you and [Company legal name], a company registered in Pakistan with its registered office at [Registered address] ("EVDost", "we", "us" or "our").
These Terms apply to the EVDost website at getevdost.com, the EVDost web app, any EVDost mobile app, and any related service we provide (together, the "Platform").
Our Privacy Policy explains how we handle your personal information and forms part of these Terms.
You accept these Terms electronically, by ticking the acceptance box when you sign up, or by using the Platform. Under the Electronic Transactions Ordinance, 2002, your electronic acceptance has the same effect as a signature on paper. We keep a record of when you accepted and which version you accepted.
3. Definitions
In these Terms:
- "Driver" means a user who uses the Platform to find and use a charger.
- "Host" means a user who lists a charger on the Platform, whether an individual, a business or any other organisation.
- "Charger" means any electric vehicle charging equipment listed on the Platform, together with its cables, sockets, wiring, electricity supply, parking space and the premises where it is located.
- "Session" means any use, or attempted use, of a Charger arranged through the Platform, including arriving at, parking at, plugging in, charging, unplugging and leaving the premises.
- "Listing" means the information a Host publishes about a Charger, including its location, price, hours, photos and description.
- "User Content" means anything a user submits to the Platform, including Listings, photos, reviews and messages.
- "EVDost Parties" means EVDost and its owners, shareholders, founders, directors, officers, employees, contractors, agents, successors and assigns.
5. Who can use EVDost
To use the Platform you must:
- be at least 18 years old and legally able to enter into a contract under the laws of Pakistan;
- have a valid Pakistani mobile number that belongs to you;
- give accurate, current and complete information, and keep it up to date;
- not have been suspended or removed from the Platform before.
If you use the Platform for a business, you confirm that you are authorised to accept these Terms for that business, and the business is bound by them.
6. Your account and verification
- You sign in using a one-time code sent to your mobile number. Keep your phone and codes secure. You are responsible for everything done through your account, whether or not you authorised it.
- Tell us immediately through the Contact page if you think someone else has accessed your account.
- Drivers do not need to register a vehicle. Hosts must complete a basic identity check, usually by providing their CNIC or another government-issued ID, and a photo of their Charger.
- Verification only confirms that the information provided appeared genuine to us at the time. It is not a background check, a safety inspection, an endorsement or a guarantee of any kind. You must use your own judgement when dealing with other users.
- We may ask for more information, refuse an account, or refuse or remove a Listing at any time, at our discretion, without giving a reason.
- You may not sell, transfer, lend or share your account.
7. Host responsibilities
If you list a Charger, you confirm, promise and agree that:
- You own the Charger and premises, or have all permissions needed to share them, including from any landlord, building management, housing society, employer or co-owner.
- You are solely responsible for complying with all laws, regulations, licences, approvals and rules that apply to your Charger and to sharing it, including any rules of NEECA, NEPRA, your electricity distribution company, local authorities and building or society rules. EVDost does not advise on, check or guarantee compliance, and does not represent that any licence is or is not required.
- You are solely responsible for the safety of your Charger and premises, including correct installation, earthing, wiring, cables, maintenance, signage, lighting, parking safety and any hazards on your premises.
- Your Listing is accurate, including the location, plug type, power, price, hours, photos and availability, and you will keep it up to date, including during load-shedding or faults.
- You will not list a Charger you know or suspect is faulty, damaged or unsafe, and you will pause your Listing immediately if a problem arises.
- You are responsible for your electricity bills and for any tax, duty or reporting on money you earn through the Platform.
- You are responsible for deciding whether to insure your Charger, premises and activities. EVDost provides no insurance for Hosts or Drivers.
- You are responsible for anyone you allow onto your premises, and for any instructions you give Drivers.
- You may decline any request and may end a Session at any time for safety or other genuine reasons.
8. Driver responsibilities
If you use a Charger, you confirm, promise and agree that:
- You are legally entitled to drive and use the vehicle you bring, and it is roadworthy and in a safe condition to charge.
- You are solely responsible for checking that a Charger is compatible with and safe for your vehicle before connecting it. If anything looks damaged, unsafe or wrong, do not use it.
- You will follow the Host's reasonable instructions, the vehicle manufacturer's guidance and any instructions shown on the Charger.
- You will tap Start when you connect and Stop when you finish, so the Session time is recorded correctly.
- You will respect the Host's property, privacy and neighbours, park only where allowed, and leave the space as you found it.
- You are responsible for your vehicle and its contents, your passengers, and any damage or injury you cause.
- You are responsible for deciding whether your vehicle and activities are insured.
9. Sessions, requests and cancellations
- A Driver may ask to charge now or at a later time. A Session is only arranged once the Host confirms it.
- Either user may cancel before the Session starts. Repeated late cancellations or no-shows may lead us to limit or suspend an account.
- The Session time recorded on the Platform, from Start to Stop, is used to calculate the price. If a user forgets to tap Stop, we may end the Session automatically or adjust the time based on the information available to us. Our decision on the recorded time is final, except in the case of obvious error.
- Charging speed depends on the vehicle, the Charger, the electricity supply and other conditions. Any cost or distance estimate shown on the Platform is only an estimate and is not guaranteed.
- Load-shedding, power cuts, voltage problems and faults can stop a Session at any time. Neither EVDost nor the Host is responsible for these events.
10. Prices and payments
- Each Host sets their own hourly price. Sessions are charged in 10-minute blocks for the time between Start and Stop, plus any minimum time set by the Host and shown before the Session.
- For now, Drivers pay Hosts directly through Raast or another method they agree between themselves. EVDost does not receive, hold, process, transfer or guarantee these payments, and is not responsible for any payment that is late, wrong, missing, reversed or disputed.
- Users are responsible for checking payment details before paying. EVDost is not responsible for money sent to the wrong account.
- EVDost does not currently charge Drivers or Hosts any fee. We may introduce fees or a commission in future. We will show any fee clearly in the Platform before it applies to you, and you can stop using the Platform if you do not agree.
- If we later process payments through a licensed payment provider, additional terms will apply to those payments and will be shown to you before you use that feature.
11. Things you must not do
You must not, and must not help anyone else to:
- give false, misleading or someone else's information, including a false identity or ID document;
- list a Charger you are not entitled to share, or that does not exist;
- damage, tamper with or misuse any Charger, vehicle or property;
- harass, threaten, discriminate against, defraud or harm any person;
- use the Platform for anything illegal, including activities prohibited under the Prevention of Electronic Crimes Act, 2016;
- post content that is false, defamatory, obscene, hateful or infringes anyone's rights;
- ask for or take payment above the price shown on the Platform, or use the Platform to arrange transactions that are not charging;
- copy, scrape, reverse engineer, overload, attack or interfere with the Platform, or try to access accounts or data that are not yours;
- create more than one account, or create an account after we have suspended you.
12. Reviews and other content
- You are responsible for your User Content and confirm you have the right to share it.
- You give EVDost a worldwide, royalty-free, non-exclusive, transferable licence to use, host, copy, display, adapt and publish your User Content to run, improve and promote the Platform. This continues for content already shared with others after you delete your account.
- Reviews must be honest and about a real Session. We may edit, hide or remove any User Content at our discretion, but we are not obliged to monitor or check it.
13. Problems between users
- Any dispute about a Session, including damage, injury, payment, conduct or property, is between the Driver and the Host. You agree to try to resolve it directly with the other user first.
- We may, but are not obliged to, help users communicate or review Session records. Any help we give is voluntary, does not make us responsible for the outcome, and does not create any obligation on our part.
- You agree not to involve EVDost in any claim, complaint or legal action against another user, except to request information we are legally required to provide.
- If you are in danger or a crime has been committed, contact the police or emergency services first.
14. Your risk and release
Using chargers and electricity involves risk, including electric shock, fire, damage to vehicles and batteries, injury, theft and property damage. You understand and accept these risks.
- You take part in any Session voluntarily and entirely at your own risk.
- To the maximum extent permitted by law, you release the EVDost Parties from all claims, demands, losses and liabilities of any kind, known or unknown, arising from or connected with any Session, any Charger, any premises, any vehicle, or the acts or omissions of any user.
- This release applies whether the claim is based on contract, negligence, tort, statute or any other legal basis, to the fullest extent the law allows.
15. No warranties
To the maximum extent permitted by law:
- The Platform and all information on it are provided "as is" and "as available", without any warranty of any kind, whether express, implied or statutory.
- We do not warrant that the Platform will be available, uninterrupted, secure, error-free or free of harmful code, or that maps, locations, prices, availability, estimates or other information will be accurate or complete.
- We make no warranty about any Charger, Host, Driver, vehicle, premises, Session or result.
16. Limits on our liability
To the maximum extent permitted by law:
- The EVDost Parties are not liable for any injury, death, illness, damage to property or vehicles, theft, loss of electricity, battery damage, fire, or any other loss arising from or connected with any Session, Charger, premises, vehicle or user.
- The EVDost Parties are not liable for any indirect, incidental, special, consequential or punitive loss, or any loss of profit, income, business, data, goodwill or time.
- The EVDost Parties are not liable for any failure or delay caused by events outside our reasonable control, including load-shedding, power or network failures, natural disasters, unrest, government action or failures of third-party services.
- The total liability of the EVDost Parties for all claims relating to the Platform or these Terms is limited to the greater of (a) the total fees you paid to EVDost in the 3 months before the claim arose, or (b) PKR 5,000.
- No owner, founder, director, officer or employee of EVDost has any personal liability to you in connection with the Platform or these Terms. Any claim may only be brought against the company.
- Nothing in these Terms limits liability that cannot be limited under the laws of Pakistan, such as liability for fraud. Where the law does not allow a limit to apply in full, it applies to the fullest extent allowed.
17. Your promise to cover our costs
You agree to defend, indemnify and hold harmless the EVDost Parties from and against any claims, actions, demands, losses, damages, fines, penalties, costs and expenses, including reasonable legal fees, arising from or connected with:
- your use of the Platform or any Session you take part in;
- your Charger, premises, vehicle, Listing or User Content;
- your breach of these Terms or of any law, regulation, licence or third-party right;
- any dispute between you and another user or any third party;
- any information you give that is false or misleading.
We may take control of the defence of any claim at your expense, and you will cooperate with us.
18. Suspension and closing accounts
- We may suspend, restrict or close your account, remove any Listing or User Content, or refuse service at any time, with or without notice, if we believe you have broken these Terms, the law, or put anyone at risk, or for any other reason at our discretion.
- You may close your account at any time from your account settings.
- Sections that by their nature should continue after your account closes continue to apply, including Sections 7, 8, 10 and 12 to 22.
19. Our name and platform
The EVDost name, logo, website, apps, software, designs and content belong to EVDost or its licensors and are protected by law. We give you a limited, personal, non-exclusive, non-transferable and revocable permission to use the Platform as these Terms allow. You may not use our name or logo without our written permission.
20. Other services
The Platform uses or links to services run by others, such as maps, SMS providers, banks and Raast. Those services have their own terms, and EVDost is not responsible for them.
21. Governing law and disputes with EVDost
- These Terms are governed by the laws of the Islamic Republic of Pakistan.
- If you have a dispute with EVDost, contact us first through the Contact page. We will try to resolve it within 30 days.
- If it is not resolved, the dispute will be finally settled by arbitration under the Arbitration Act, 1940, by a sole arbitrator agreed by both sides or, failing agreement, appointed by the competent court. The seat of arbitration is [Arbitration city], and the proceedings will be in English.
- To the extent the law allows, claims must be brought individually, not as part of a group or representative action, and within one year of the event giving rise to the claim.
- Nothing in this section stops EVDost from seeking urgent relief from a court to protect its rights, property or users.
22. General
- Changes. We may update these Terms. If we make important changes, we will tell you in the Platform and ask you to accept the new version before you continue using it. The version number and date at the top show the current version.
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and EVDost about the Platform.
- Severability. If any part of these Terms is found invalid or unenforceable, the rest continues to apply, and that part applies to the fullest extent allowed.
- No waiver. If we do not enforce a right straight away, we have not given it up.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours, for example if EVDost is sold or reorganised.
- Notices. We may send you notices through the Platform, by SMS or to the contact details on your account. Legal notices to us must be sent to [Legal email].
- Language. If these Terms are translated, the English version applies in case of any difference.
